Terms and conditions
of purchase
1. Seller and scope
Luxury Fer is the brand used by Luxury F.E.R. S.r.l., unique identification code (C.U.I.) 55110957, Trade Register number J2026042646006, EUID ROONRC.J2026042646006, main activity CAEN 4777. Registered office: Bulevardul Take Ionescu, Nr. 69, Ap. 3, Municipiul Timișoara, Jud. Timiș (Romania). Contact: luxferw@gmail.com. The returns address remains to be defined.
Luxury Fer sells in its own name, including watches consigned by third parties. The buyer’s contractual seller is the company identified above. Consignment does not require the buyer to seek recourse from the previous owner.
2. Watches and pre-purchase information
Written confirmation for each watch must state the brand, model, reference, condition, any defects, included accessories and documents, and authenticity checks carried out. Photographs, wear, work performed, replacements and limitations of documentation must be described before ordering. Website information does not replace the description of the specific watch covered by the contract.
3. Price, order and payment
Before acceptance, the total price, currency, tax treatment, delivery charges and any additional costs must be disclosed. Payment is accepted exclusively by bank transfer. Any deposits and reservation conditions: [TO BE DEFINED]. When the contract is concluded and how confirmation is provided on a durable medium: [TO BE DEFINED].
An enquiry or appraisal request by email does not itself constitute an order. The buyer must receive the applicable terms before assuming a payment obligation. Closing the privacy notice with “Accept” does not constitute acceptance of these terms.
4. Delivery
Delivery is by collection or guaranteed and insured shipping. Countries served, costs and delivery times: [TO BE DEFINED]. For consumer sales, unless otherwise agreed, delivery takes place without undue delay and within 30 days of concluding the contract.
5. Consumer withdrawal
For distance purchases, a consumer normally has 14 days from taking physical possession of the watch to give notice of withdrawal without stating a reason. Special periods and statutory exceptions remain applicable. A watch being used or collectible is not, by itself, an exclusion.
Notice may be sent to luxferw@gmail.com. Returns address and allocation of direct return costs: [TO BE DEFINED AND DISCLOSED BEFORE PURCHASE]. Refunds, returns and any diminished value will be governed by Articles 13–14 of OUG 34/2014; the operational text must be completed before use.
Optional notice template: “I give notice of withdrawal from the purchase of the watch [model/reference], order [number], received on [date]. Name, address, date.” This template does not replace the information obligations or statutory form to be provided to the consumer.
For purchases by businesses or professionals, the consumer right of withdrawal does not apply automatically.
6. Conformity and support
Consumer sales are subject to the conformity protections of OUG 140/2021. For lack of conformity, statutory remedies include repair or replacement and, where applicable, price reduction or termination. For used goods, any shortened liability period requires agreement and cannot be less than one year from delivery. No reduction of this period is stipulated.
Any commercial warranties must be specified separately and do not limit statutory rights. To report a problem, email luxferw@gmail.com identifying the watch and the issue.
7. Applicable law and complaints
The final text must specify the application of Romanian law while preserving any mandatory consumer protection rules applicable to cross-border purchases. No exclusive jurisdiction clause limiting the buyer’s mandatory rights is provided.
